The 1999 Constitution and the INEC Electoral Guidelines.

Section 1. (1) This Constitution is supreme and its provisions shall have binding force on the authorities and persons throughout the Federal Republic of Nigeria.

(3) If any other law is inconsistent with the provisions of this Constitution, this Constitution shall prevail, and that other law shall, to the extent of the inconsistency, be void.

Section 179. (2) A candidate for an election to the office of Governor of a State shall be deemed to have been duly elected where, there being two or more candidates -

(a) he has the highest number of votes cast at the election; and

(b) he has not less than one-quarter of all the votes cast in each of at least two-thirds of all the local government areas in the State.

INEC's election guideline made pursuant to Section 153 of the Electoral Act stipulates a rerun if the margin of victory in an election is lower than the number of voters in units where elections are cancelled.
